Terms, Conditions and Privacy

Future IT Hosting provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of Future IT Hosting are subject to the following terms of service:


Indemnification Policy

You agree to use all Future IT Hosting services and facilities at your own risk. Future IT Hosting specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Future IT Hosting be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Future IT Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Future IT Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Future IT Hosting against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with Future IT Hosting's server.

Future IT Hosting reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Future IT Hosting's server. Future IT Hosting shall be the sole judge of what violates this Policy.


Billing & Refunds:

At this time we bill monthly, quarterly, semi-annually and annually, depending upon the product. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and Domain Name registration fee are nonrefundable as per AUDA).

We accept Visa, Master Card, Direct Debit and PayPal. For webhosting plans we can setup your account prior to payment. Their are no contractual periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.


Cancellations:

Cancellations must be submitted prior to the due date of any automatically renewing services. They can be made in writing to sales@futureithosting.com.au or via or via your secure online login.


Late Payments:

All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 5 days after deactivation, your account will be suspended. If you will not pay for service renew in 30 days after deactivation, your account will be terminated. You will receive an email reminder 5 days till deactivation.


Acceptable Use Policy:

All services provided by Future IT Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Future IT Hosting and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all Future IT Hosting servers. This includes sites that include sexually explicit or hardcore images and/or advertising.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.


Banned Scripts:

The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.

  • Proxy servers
  • Mail bombers
  • Anonymous mailers
  • IP spoofers
  • Port scanners
  • Hivemail
  • Telnet or SSH Access Scripts
  • nph-proxy (and other scripts what operates like proxy)
  • UBB (Ultimate Bulletin Board, all versions)
  • lstmrge.cgi
  • phpShell
  • FormMail.cgi, FormMail.pl from Matt's Script Archive are not allowed.

  • LIMITATION OF LIABILITY:

    Future IT Hosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Future IT Hosting servers going off-line or being unavailable for any reason whatsoever. Furthermore, Future IT Hosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Future IT Hosting servers. All damages shall be limited to the immediate termination of service.


    DISCLAIMER:

    Future IT Hosting cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Future IT Hosting are resold. Thus, certain equipment, routing, software, and programming used by Future IT Hosting are not directly owned or written by Future IT Hosting. Moreover, Future IT Hosting holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Future IT Hosting sees fit. FURTHERMORE, Future IT Hosting retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

    PRIVACY

    1. WHAT DO WE DO WITH YOUR INFORMATION?

    Future IT Hosting will be what’s known as the “Controller” of the personal data you provide to us.
    When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. We do not sell, trade, disclose or give away any customer’s personal information.

    When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

    Email marketing (if applicable): If you choose to contact us via our website or subscribe to our mailing list we require you to provide your name, email address, telephone number and other information found on our enquiry forms relating to your requirements. If you have subscribed to our mailing list and would like to be removed simply click on the unsubscribe link at the bottom of the next newsletter you receive from us.

    2. CONSENT

    When you provide us with personal information to create an account, place an order, arrange for a delivery or return a purchase, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

    If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, on your account page by using our contact us form.

    3. DISCLOSURE

    We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

    4. PAYMENTS

    We use a third party payment processor(s) to process payments made to us. In connection with the processing of such payments, we do not retain on our servers any personally identifiable information or any financial information such as credit card numbers.

    5. THIRD-PARTY SERVICES

    In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

    However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

    For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

    In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

    As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

    Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

    When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

    6. SECURITY

    To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

    All the personal data we process is processed by our staff in Australia however for the purposes of IT hosting and maintenance this information is located on servers within New South Wales on a secure server behind a firewall. No 3rd parties have access to your personal data unless the law allows them to do so.
    We have a Data Protection regime in place to oversee the effective and secure processing of your personal data.

    7. AGE OF CONSENT

    By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

    8. CHANGES TO THIS PRIVACY POLICY

    We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

    If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
